These Terms govern your use of BasketWise, a grocery comparison and shopping-list service operated by Ingaro (Pty) Ltd (“Ingaro”, “we”, “us”). Contact us at info@ingaro.co.za.
1. Acceptance and eligibility
By creating or using an account, you agree to these Terms and acknowledge the Privacy Notice. You must be at least 18 years old and legally capable of agreeing to these Terms.
2. What BasketWise provides
BasketWise helps users compare grocery listings, prices, promotions, pack sizes and branch availability; save products; and prepare shopping lists. BasketWise is an information and planning service. It does not sell groceries, take payment, fulfil orders, or guarantee that a retailer will honour a displayed price or have stock available.
3. Retailer information and links
Retailer information can change at any time. We identify when cached information was checked and refresh it periodically, but the retailer’s own product or checkout page is the final source for price, availability, promotions, product details and purchase terms. Links to retailers open third-party services governed by their own terms and privacy practices.
4. Independence and trademarks
BasketWise is independent and is not endorsed by or affiliated with Woolworths, Pick n Pay, Checkers, or their related companies unless we expressly state otherwise. Retailer names, product names, images and trademarks belong to their respective owners and are used for identification and comparison.
5. Your account
You must provide accurate account information, protect access to your Google account, and notify us of suspected unauthorised use. You are responsible for activity through your BasketWise account. You may delete your account from Settings.
6. Acceptable use
You may use BasketWise for personal, lawful grocery planning. You may not interfere with the service, bypass security or usage controls, introduce harmful code, scrape or bulk-extract BasketWise data, impersonate another person, or use the service in a way that infringes rights or breaks applicable law.
7. Availability and changes
We may improve, change, suspend or discontinue features. We may restrict accounts reasonably believed to threaten security, misuse the service, or materially breach these Terms. We will update the version date when these Terms materially change and may require renewed acceptance.
8. Disclaimers and liability
To the extent permitted by law, BasketWise is provided “as is” and “as available”. We do not warrant uninterrupted operation or the completeness or accuracy of third-party information. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded. Subject to that limitation, Ingaro is not liable for indirect or consequential loss arising from reliance on retailer information, third-party services, or service interruption.
9. Intellectual property and takedowns
BasketWise software, design and original content belong to Ingaro or its licensors. If you believe content infringes your rights or should be removed, follow our Takedown Procedure.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa. Courts with jurisdiction in South Africa may hear disputes, subject to any mandatory consumer rights and dispute procedures.
